Terms & Conditions

Working Hours & Client Dealing Timings

CYBEY has working hours from morning 9 AM to 5 PM from Monday till Saturday and employees are allowed to stay in the CYBEY premises for as long as they want in the presence of any top-level management member.

The CYBEY premises will remain close on the national & international holidays, CYBEY founding day, the government declared holidays (festivals and other holidays) and emergency situations such as a pandemic, natural or man-made disaster, etc., and all the CYBEY employees and staff members will have a holiday on these days.

Client dealing will also be done during the company working hours and on working days only.

Contract Terms & Conditions

The client/customer will be asked to read the contract before signing and finalizing the project. Given below are the following are the terms and conditions which will be applicable after signing the contract:

  1. The contract will be valid only if it is printed on the CYBEY Letterhead and signed by all the partners in the partnership firm along with the client/customer.
  2. The service/product details written in the contract will not be modified under any circumstances after the contract is signed by both CYBEY and the client/customer.
  3. Any further changes or additions in the contract will be chargeable by the CYBEY from the client/customer.
  4. The contract will be signed under the presence of all the CYBEY partners and clients/customers. No other parties will be present during the signing of the contract. The recording of the whole meeting may or may not be made as proof of who all were present at the venue when the contract was being signed by CYBEY partners and client/customer.
  5. The contract can be canceled as per the conditions stated under the Refunds and Reimbursement heading and the Refunds and Reimbursements will be made as per the terms and conditions stated under the Refund.
  6. The payment structure will be mentioned in the contract will be from either of the following mentioned below:
    1. 30-40-30:
      30%: Advance
      40%: When half work is done
      30%: On the delivery of the work
    2. 60-40:
      60%: Advance
      40%: On the delivery of the work
    3. Monthly Installments System: The total amount of the project will be decided as per the duration of the project. (Example: if a service or a product manufacturing is 6 months long and costs INR 60,000, then INR 10,000 installments will be made) The final service or product manufacturing will be delivered after the last installment is received. Advanced payments and installments can also be made by the client/customer.
      NOTE: IF THE client/customer WANTS TO USE THIS PAYMENT STRUCTURE, THEN THE SERVICE OR PRODUCT MANUFACTURING MUST HAVE A DURATION OR TIMELINE OF MORE THAN 3 MONTHS.
  7. Module/Features/Phase-Based Payment: The cost is divided among the various features, modules, and phases requested by the client in the service or product. The client/customer needs to make the payment on the delivery of each feature, module, or phase.
    NOTE: IF THE client/customer WANTS TO USE THIS PAYMENT STRUCTURE, THEN THE SERVICE OR PRODUCT MANUFACTURING MUST HAVE 6 OR MORE FEATURES OR MODULES AND 3 OR MORE PHASES.
  8. All the payments will be received by CYBEY from the client in the working days only.
  9. Upon the failure of payment due to any reason under any situation or circumstances, the working of the service or manufacturing of the product will be stopped immediately by CYBEY and will be resumed after the client/customer has made the payment which he/she failed to make. The CYBEY will have the copyright on the project in this case and the copyright will be given back to the client if the payment is made.
  10. If the project timeline exceeds the timeline proposed by CYBEY by a difference of more than 3 to 7 working days because of the client, then CYBEY can ask for more payment from the client for the time the project timeline has exceeded the proposed timeline.
  11. If any feature, module, or phase is marked as complete by the client/customer and CYBEY or has been accepted by the client/customer, then no modifications will be made in that feature, module, or phase under any circumstances or situations without receiving the cost that is associated with the change. If that feature, module, or phase experiences some error or failure, it will be diagnosed or debugged and treated without any further charges.
  12. If there is any security flaw in the service or product, it will be patched if the security flaw is mentioned in the contract or documentation or the service or product. If it is not present, the CYBEY is liable to ask the client/customer to pay the cost associated with that patch which needs to be installed to remove that security flaw.
  13. If there is any feature, module, or phase missing in the service or product which has been mentioned in the contract or document of that service or product, it will be added by CYBEY in the same budget which has been paid by the client/customer.

Privacy Policy

CYBEY will keep all the customer details confidential along with the work done by CYBEY for the client/customer from everyone outside the CYBEY and the top-level management or sales, customer care, and marketing department of the CYBEY. The client/customer's details will be used by the company for only contacting them regarding that client's/customer's service or product and providing training to our Artificial Intelligence-based agents or the support team which will enable CYBEY to provide you a better service quality along with a more timely and efficient approach towards the client's/customer's service or product.

Refunds & Reimbursements

Refunds and Reimbursements of advance or installments of the services paid by you (client/customer) to CYBEY till date will be provided by CYBEY in the following situations:

  1. Cancellation of service or product: CYBEY may cancel your service or product manufacturing or creation at any point due to any of the following reasons:
    1. The ongoing project costs have changed due to economic changes and we are no longer able to continue the client work and the client is unable to afford the extended cost of the service or product. In this case, the client's budget that has been consumed by CYBEY will not be refunded but the rest will be refunded (if received any extra amount in cash or bank transfer) along with the work that has been done in that consumed budget.
    2. If CYBEY team is busy with some projects in the company which is disabling CYBEY to work or complete your project at the moment. If this happens, CYBEY gives our full support and cooperation to the next company to which the client is willing to forward their project but, we will provide a refund of the budget that has been received by us and has not been used or exhausted in the project.
  2. The company will give no refunds of reimbursement advance or installments of the services paid by you (client/customer) to CYBEY to date under the following conditions mentioned below:
    1. If the client/customer is not cooperating or is busy to approve or check the work on a timely basis and thus delaying the work completion timeline, then the CYBEY is not liable for any refunds but, can demand more payment for the delays from the client/customer.
    2. If the client's expectations are too high that it is exceeding the project budget and thus, violating and negating the agreement terms, in this case, CYBEY is liable for no refunds or reimbursement of any payments received bus CYBEY at all.
    3. If CYBEY is unable to meet your expectations because the client is not willing to tell the detailed changed in the product or the client is not accepting the work done by CYBEY as per his/her directions. We will be ready to work if a client tells us about the changes required to be done otherwise the deal is closed from our side i.e. CYBEY and no refunds shall be given to the advance or installments paid by the client/customer to CYBEY till date.
    4. If the client/customer does any kind of rude behavior with any of the CYBEY employee (which the CYBEY will need to prove), the company shall not refund any amount received by the CYBEY from the client/customer and is liable to file an FIR or police complaint regarding the same because the client has not hired CYBEY as there employee or has bought them to do just there work only. CYBEY has just offered the client/customer their services to help the client/customer carry out or start there work smoothly on contract basis which can be canceled by CYBEY or the client/customer at any point in time due to the mistreatment. Therefore, CYBEY is a free and separate entity from any client/customer and no client/customer shall treat CYBEY as their property. But, if any CYBEY employee mistreats the client/customer (which the customer will need to prove), then the client can claim a 100% refund and do an FIR or police case against CYBEY.
  3. The team fails to connect for the first time after receiving the advance to the customer for more than a month, CYBEY is liable to give you a 100% refund of all the payment that has been received by CYBEY in the form of advance payment for getting service or product manufacturing requested by the client/customer started.
  4. If we are not able to complete your request due to the lack of our knowledge or experience in the field you are seeking service from CYBEY, the following conditions given below shall be applied:
    1. Client requested something that is not possible to be created using the currently available technologies, CYBEY will give a 100% refund.
    2. The project specifications such as design, idea, the storyline of any animation, etc. provided by CYBEY is not accepted by the customer but, the customer is giving his/her inputs on how it should look like or how the flow of the work should be, CYBEY will give a 100% refund.
    3. But, if the client is not giving any inputs or directions in which he/she is seeking the work to be done but just saying yes or no and rejecting their directions and ideas after showing beta versions or design samples or prototypes of the actual product created as per the customer requirements and with full specifications, CYBEY is not liable for any refunds in this situations.
  5. If the client decides to cancel the project due to any reason, the client CYBEY is liable to refund the payment received after the advance i.e. the very first payment which is made by the client/customer as per their own choice. In case, if 50% or more or even 100% payment is received by the CYBEY as an advance i.e. the first payment from the client/customer, he/she will not be given any refunds. If the client wants to continue or start their work again after the cancellation of the service or product manufacturing with CYBEY, he/she will need to give the 50% of the total project's cost as an advance. After this only, CYBEY can restart or resume their work from the point it was on when it was stopped by the customer. In this case, CYBEY will not scrap the work done for the client and shall preserve it for 2 years after the date of the cancellation of the service or product manufacturing. If the client does not come back, then the CYBEY is liable to use that client's work for their own needs and work because the client has no copyright on the work if it is not completed and canceled by the client in the middle of the development phase itself. If the work is stopped in the testing phase or delivery phase, the work shall be handed over to the client and will be scrapped by the CYBEY. It will not be used by CYBEY under any circumstances for our own their own needs and work.

NOTE: THE CLIENT SHALL TALK TO US ABOUT HIS/HER GRIEVANCE ON THE TERMS & CONDITIONS GIVEN BY CYBEY IN THIS DOCUMENT. THE REST OF THE CONVERSATIONS SHALL NOT BE ENTERTAINED BY CYBEY UNDER CIRCUMSTANCES.
